By creating an account, accessing, or using TooSimple.io, you acknowledge that:

• You have the legal authority to enter into this agreement
• You agree to comply with all applicable laws and regulations

2. Description of Service

TooSimple.io is a testimonial collection and display platform that enables you to:

• Create customizable testimonial collection forms
• Collect text and video testimonials (up to 90 seconds per video)
• Manage, approve, and organize collected testimonials
• Display testimonials on your website using embeddable widgets
• Customize the appearance of collection forms and display widgets

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscriptions & Billing

Subscription Plans

Payment Processing

All payments are processed through Polar.sh, our Merchant of Record. By subscribing, you authorize Polar.sh to charge your payment method for the subscription fees. Polar.sh handles all payment processing, tax collection, and compliance.

Automatic Renewal

Monthly and annual subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings or the Polar.sh customer portal.

5. Refund Policy

Refunds are typically processed within 2-3 business days. After the guarantee period, refunds are provided at our sole discretion. Contact us at @PipolmPk on X to request a refund.

6. Acceptable Use Policy

You agree not to use TooSimple.io to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload or distribute malicious code, viruses, or harmful content
• Collect testimonials containing illegal, defamatory, or abusive content
• Harass, abuse, or harm other users or third parties
• Send spam or unsolicited communications
• Impersonate another person or entity
• Attempt to gain unauthorized access to our systems or other accounts
• Interfere with or disrupt the Service or its infrastructure
• Use automated systems (bots, scrapers) without our permission
• Create fake or misleading testimonials
• Resell or redistribute the Service without authorization

We reserve the right to remove any content and suspend or terminate accounts that violate this Acceptable Use Policy, without prior notice or refund.

7. Content Ownership & Licenses

Your Content

You retain ownership of all testimonials, videos, images, and other content you collect through TooSimple.io ("Your Content"). By using our Service, you grant us a limited, non-exclusive, royalty-free license to store, process, compress, and display Your Content solely for the purpose of providing the Service.

Testimonial Submitter Rights

When someone submits a testimonial through your collection form, they grant you the right to display their testimonial on your website and marketing materials. You are responsible for obtaining appropriate consent from testimonial submitters for how you use their content.

Content Responsibility

You are solely responsible for the content you collect and display. We do not pre-screen testimonials but reserve the right to remove content that violates these Terms or applicable laws.

8. Intellectual Property

TooSimple.io and its original content, features, and functionality are owned by TooSimple.io and are protected by international copyright, trademark, and other intellectual property laws. This includes:

• The TooSimple.io name, logo, and branding
• Our website design and user interface
• Our proprietary software and code
• Documentation and marketing materials

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

9. Service Disclaimers

We make reasonable efforts to ensure service availability but do not guarantee any specific uptime. We may perform maintenance that temporarily affects service availability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOOSIMPLE.IO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Actions of third parties or other users
• Content submitted by testimonial providers

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless TooSimple.io and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you collect, store, or display through the Service.

12. Termination

By You: You may terminate your account at any time by contacting us or using account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods after the guarantee period.

By Us: We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

Effect of Termination: Upon termination, your right to access the Service ceases immediately. We may delete your account data, including testimonials and videos, within 30 days of termination. We recommend exporting your data before canceling.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of France.

If you are a consumer residing in the European Union, you may also benefit from mandatory provisions of consumer protection laws in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes, we may also notify you via email.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and close your account.
